A recent decision, CNESST v. Automobiles Popular Inc. (2019 QC CQ 206) has confirmed that a worker can get commissions paid on negotiated offers to purchase prior to termination, especially when the basic monthly salary is minimal and commission pay is a real way for the employee to benefit from the fruits of his work, all in accordance with section 46 of the Charter of Rights and Freedoms, which states that every person who works has the right to fair and reasonable working conditions.
This payment of commissions is possible even if it was provided in the employment contract that the commissions were paid only on delivery of the vehicle.
